London Cabbies launch multi-million pound group action claim against Uber

London’s cab drivers are coming together as Cabbie Group Action to bring a potential group legal action against Uber worth over £500 million for damages and loss of earnings due to the alleged unlawful operation of Uber under the relevant statutory framework.
The Group Action will bring a claim in the High Court by licensed taxi drivers in London against Uber for loss of income on the basis that Uber has operated unlawfully under the relevant statutory framework between mid-2012 to at least the end of 2017, with the intention of causing loss to the licensed taxi trade.
Supported by leading law firm Mishcon de Reya, the claim is being officially backed by a wide variety of organisations involved in the licensed cab trade, including:

With a third party funder in place, cabbies can join the claim knowing that their legal costs will be covered.
Cabbies are being encouraged to sign up to the claim by registering their interest on the website www.cabbiegroupaction.com.
Commenting on the claim, the LTDA’s General Secretary, Steve McNamara said, “We recognise that there needs to be a level playing field between minicabs and licensed cabs on London streets but we believe Uber has operated unlawfully, resulting in a loss of earnings for many qualified licensed cab drivers. It is vital that they are recompensed for their losses. Perhaps only then will licensed cabs and Uber be operating on an even footing, which we all would welcome.”
Unite the Union’s Mike Hedges said, “Unite is pleased to support Cabbie Group Action against Uber. Cabbie Group Action is important in winning back the losses that taxi drivers have suffered.”

Fury As Lifer Policeman Serial Rapist Is Released After Only 7 years

Victims' fury as rapist policeman, 50, is freed from prison less than seven years after he was jailed for life for attacking up to 30 women he met on duty.

A rapist policeman has been freed from prison less than seven years after he was jailed for life for attacking up to 30 vulnerable women he had met on duty.

Stephen Mitchell raped and sexually abused heroin addicts and a disabled teenager by offering them help while in custody, then demanding sexual favours afterwards.

The former soldier was handed two life sentences at Newcastle Crown Court in 2011 and was told he would not be eligible for parole for at least seven and a half years.

But the 50-year-old has since been released and was seen enjoying life on the outside, riding a £500 bike, according to a report by the Sunday People.

Mitchell's victims and campaigners are outraged over his release, saying it was wrong Mitchell, who was deemed a 'high risk to women' by psychiatrists, was freed. 

One victim told the Sunday People: 'It's wrong that he can get on with his life, when he has ruined so many others.'

Another added: 'I certainly didn't expect him to get out so quickly.

'I have never, ever heard of anyone getting parole first time around for such a serious offence, given the fact he was so manipulative and never admitted anything.

'He deliberately chose victims who were vulnerable and wouldn't be ­believed if they ever dared speak up.'


She continued: 'I honestly think he has used everything he learned in the Army and the police to help him get parole by just telling them what he knew they would want to hear. He knows exactly what he's doing.

'He managed to get away with what he was doing, despite being in the police, so he is very cunning.' 

Labour's shadow home ­secretary Yvette Cooper called for the Parole Board to review its decision.

She said: 'We urgently need to know what the Parole Board's reasons were because to most people this really does not look like justice for victims. 

'The Justice Secretary needs to tell us urgently what progress he has made since his decision on John Worboys to stop the same things happening all over again.'

Uber driver found guilty four and a half years after the tragic death of six year old Sofia

Four-and-a-half years after the tragic death of 6 year old Sofia Liu who was run over while walking across a road in San Francisco, Uber driver Syed Abid Muzaffar, has been found guilty of vehicular manslaughter. On December 31, 2013, drove his Honda Pilot SUV through a crossing knocking over Sophia Liu, 6, her brother Anthony Liu, 5, and her mother Huan Hua Kuang. All three family members suffered serious injuries, with Sofia's proving fatal. Muzaffar has spent the last four-and-a-half years out on bail following being arrested and charged with one count of misdemeanour vehicular manslaughter. Kuang was adamant that she saw Muzaffar on his phone right before the collision that killed her daughter, but the Uber drivers public defender, Sliman Nawabi, said that the collision was caused by an infrastructure issue, not a case of negligence. Nawabi argued that is was because of bad visibility and the fact that the pedestrian light and the car traffic light had turned green at the same time which were the primary factors in the lead up to what he called "a tragic accident". Tom Ostly, District Attorney, did not agree with Nawabi's claims of it being "a tragic accident", saying that it would imply that there was nothing Muzaffar could've done to avoid hitting three people crossing the road at a "crosswalk". As reported in the SFWeekly, Ostly went on to say "You have a duty to whoever's in the crosswalk not to hit them. You don't drive unless you can see". After two days of deliberation, a jury determined that Muzaffar was guilty of vehicular manslaughter. The tragic death of Sofia and the huge medical bills of over $500,000 for her brother and mother, sparked immediate concern and debate to who would cover the insurance.
Uber said that because Muzaffar didn't have a job onboard they were not liable for any insurance bills, although Muzaffar did have the app on in between jobs. A lawsuit was filed against Uber on behalf of the family in 2014, and in 2015 the case was settled for an undisclosed amount. The whole case forced Uber to reconsider their insurance policy which now covers collisions and crashes caused by Uber drivers even if there is no passenger in the car when the incident occurs as long as the driver is logged into the drivers app and available to accept a ride. The grey area of how much responsibility big corporations take in such situations is still very much groggy, but in this instance both Muzaffar and Uber were held accountable in one way or another.

Bury cab operators to invoke a minimum standard requirement

Bury's cab industry has welcomed an initiative to invoke a basic minimum standard across the region.
Greater Manchester Mayor, Andy Burnham, is backing the plans, and wants to go further by slamming the door shut on cross-border hiring.
Concerns have been raised over cross-border hiring countrywide due to the fluctuating regional standards across the UK, where some authorities are considered to have a more lax licensing regime than others, many authorities and regulators have considered the practise a menace sue to an authorities lack of ability to perform any kind of enforcement, as well as a potential danger to the public.
It has been reported by The Bury Times that cabbies have responded favourably to the proposals, seeing it as an opportunity, not only to raise standards, but to protect the industry from the incursion of potentially sub-standard cabbies from other areas.
There will be a three month consultation once a full set of proposals have been agreed. SK

Could a simple "no right turn" be the straw that breaks the camels back for the taxi industry in London

London's world famous Oxford Street, is one of the busiest shopping streets in the world, and attracts millions of people all over the world year upon year.
Just like many other shopping streets and districts, worldwide, Oxford Street has been hit by the huge explosion in online shopping, meaning that some shops and businesses are moving their operations elsewhere.
From its most easterly point at the junction of Tottenham Court Road, to its most westerly point at the junction of Park Lane Oxford Street is 1.3 miles from end to end.
When driving from east to west in a taxi, there are 17 driveable turnings on the northern side of the road, of which 4 have a right turn available. On the southern side of the road therr are 13 driveable streets of which 5 can be accessed via a left turn when travelling east to west.
There are 4 underground stations accessible to shoppers in Oxford Street along its entire length, hundreds of buses available throughout the day, as well as a very heavy licensed London taxi presence, which includes a number of taxi ranks on Oxford Street itself, between its most westerly point and Oxford Circus. All other motor vehicles are excluded from Oxford Street between 7am and 7pm Monday to Friday, with the exception of motor cycles.
Oxford Street has a very vibrant public transport network, and it works surprisingly well, if you can disregard the lack of enforcement surrounding the exclusion of motor vehicles throughout the day and a bus network which has far too many empty buses.
Obviously pollution is high along the entire stretch of Oxford Street, however this is due to several mitigating factors.
Starting with the most obvious target, deisel vehicles contribute to a considerable level of pollution, ergo taxis come straight into any given governmental figure, council representative, or statisticians cross-hairs.
It is a fact that a slow moving or non-moving vehicle will pump put more noxious gases than a free-moving vehicle, so therefore we have to look at other factors.
The amount of empty or near empty buses taking up road-space is quite frankly incredible, why this has never been tackled is a complete mystery.
Despite the availability of buses, it is surprisingly awkward to actually pay for one if you are not from London or unfamiliar with the public transport system, with people being caught out, not being able to pay with cash when boarding a bus.
Empty or near empty buses take up road space, consequently by default they will slow other traffic down, and as a result pollution increases.
Next we have a traffic light "gating" system which jas never worked efficiently. The traffic lights have been intermittently tinkered and toyed with, ultimately to nobody's satisfaction, thus slowing traffic down even further.
Finally, we have sheer bad road planning and management,. Taxi drivers and bus drivers, being the predominant users of Oxford Street's road-space, can all see where the problems lay, and yet when issues are highlighted, they are seemingly brushed aside, on many occasions without reason.
The latest abomination to befall Oxford Street is the ban on taxis turning right from Oxford Street into Portman Street, and turning it into a right turn for buses only.
There is no logical reason for allowing one form of public transport to turn right, whilst excluding another form of public tramsport.
There have been many theories as to why a no right turn is being put in place, although nobody seems to have put forward an official reason as yet.
This has prompted the Independent Taxi Alliance (ITA) to call for a series of protests at a number of locations, where similar taxi exclusions have taken place.
Onviously there will be the usual wailing and gnashing of teeth from certain quarters within local government condemning this action, but the ITA have a very valid point in that the taxi industry is part of the public transport network, in fact this was highlighted by the Mayor himself, and as such, should be afforded the same road access as other forms of public transport.
What has also been highlighted by the ITA is the fact that while, as an example, bus drivers are paid a wage, regardless of any road conditions, taxi drivers are self-employed entities, who rely on the freedom of movement to be able to work and earn a living.
The situation at Oxford Street and Portman Street is not a one off, a prime example is the completely ludicrous taxi exclusion at Bank Junction, an exclusion which seemingly nobody agrees with unless you are a cyclist.
When you combine the Bank Junction exclusion with the plethora of roadworks in the same area, the end result is gridlock, and yet the Corproration of London seem to be completely oblivious to the situation. This therefore begs the question as to whether it is any wonder that the ITA have called for a series of protests.
The issues surrounding taxi exclusions in London has reached an intolerable level, and although there may be dialogue between local authorities and representatives of the licensed London taxi industry in trying to resolve these problems , there seems to be a fair argument for highlighting the situation.
So could the Oxford Street debacle be the straw that finally breaks the back of Londons taxi industry and lead to protests across London. SK
