Uber drivers across Australia protest against below minimum wage pay

Uber drivers in Sydney, Brisbane, Perth, Melbourne and Hobart logged off from their driver apps this morning Monday, 6, in a protest against what they believe is an unfair pricing structure which has seen fixed upfront costs replace the original "paid by time and distance" way of calculating a fare. A group called Ride Share Drivers United also want drivers to have the choice of opting out of the UberPool option without receiving penalties from Uber, and also the RSDU are calling for an increase in rates by at least 15%. Uber have been given 10 days to "meet the demands" otherwise further disruptions are being threatened, a report in the Guardian claims. A spokesperson for the RSDU has said that Uber drivers are taking home less than minimum wage by a multinational corporation who thinks it's ok to exploit them so they can offer cheap rides to customers. The spokesperson feels that customers wouldn't have to bear the brunt of a fare increase, instead Uber should lower their commission. A report in the Guardian back in March claimed that without the poorly paid labour charges, Uber would collapse. The terribly low incomes of Uber drivers are key to Uber's escalated market value the report suggested. According to the analysis taken by the Centre for Future Work says UberX drivers earn below minimum wage once all hidden costs are taken into account. Today's protest (Monday,5) took place between 7am and 9.30am, the major rush hour times when most customers need their underpaid ride-sharing drivers to take them to work.

The in and outs of the £500 million Taxi Group Action against Uber

London’s cab drivers announced today that they are to bring a potential group legal action against Uber for damages and loss of earnings.
But what does that mean and who’s behind the action?
The Group Action is being entirely funded by leading litigation funding firm Harbour Litigation Funding. The firm are currently investigating further litigation against Uber in Melbourne, Australia. Mishcon de Reya is a law firm based in London, with significant experience in group litigation. It is taking forward the group action against Uber. In the past few years it has acted for claimant groups in cases involving RBS, Royal Mail and Google.Newington Communications is a corporate and public affairs agency and is supporting Mishcon de Reya in its communications around the group action, to help get as many drivers involved as possible.
Outside of Harbour, Mishcon de Reya and Newington there are several taxi industry leaders officially pledging their support to the action. These include LTDA, LCDC, UCG, Unite, KPM Automotive, Easyrentacab, Colts Cabs, Cricklewood Carriers Cab Company, Martin Cordell and Co, Sherbet Cars, Ubiquitous and of course us here at TaxiPoint.
Group Action is a term used in the UK for when multiple claimants sharing grievances with common characteristics join together to seek a remedy against the same or multiple defendants. In other jurisdictions, this is often called a class action. In England and Wales, there are various procedural mechanisms available to bring group actions which are becoming far more regularly used. Group litigation can redress the balance between individuals and large, well-funded defendants as by joining together individuals can benefit from collective strength, expertise and the sharing of costs and risks, thereby facilitating access to justice.
The Group Action will bring a claim in the High Court by licensed taxi drivers in London against Uber for loss of income on the basis that Uber has operated unlawfully under the relevant statutory framework between mid-2012 to at least the end of 2017, with the intention of causing loss to the licensed taxi trade.
The first step in the claim is to sign up as many eligible drivers as possible to participate in the claim. Any taxi driver licensed by Transport for London to work in London may be eligible to take part if they operated as a licensed taxi driver for some or all of the period between mid 2012 to at least the end of December 2017.
The Group Action aims to demonstrate a significant overall loss of income to licensed taxi drivers collectively following Uber's entry into the London market. The total value of the claim will depend on the number of licensed taxi drivers who participate. The group are working with economists and expect that damages could be in excess of £500 million. As the group collect data from participants, the group will be able to more accurately and robustly estimate the loss attributable to Uber's unlawful operation.

Nissan e-NV200 Taxi Saves Fleets So Much Cash That It’s Like Getting A License To Print Money


British taxi company C&C Taxi from St. Austell was already featured by Nissan as one of the LEAF and e-NV200 pioneers. 

Now, it turns out that by switching to EVs, C&C acquired a license to print money (no, not really), saving over €79,000 in 18 months on fleet costs.

According to the press release, the annual savings per car on fuel alone in the UK stands at €11,374 (£8,500) or over $12,000.

To make savings like that you need to drive a lot, and to drive a lot you need to charge a lot, and to charge a lot you need to do it fast so C&C installed two DC quick chargers – one at its office and one in an industrial estate. The result is 77,000 miles (123,000 km) in just 12 months for one of the cars, which translates to some 6,400 miles (10,250 km) a month!


Neither C&C Taxi nor Nissan provided the total payback period for the cars (including fast chargers) compared to conventional cars, which maybe would convince more taxi companies to switch to EVs.

Nissan’s Director of Electric Vehicles, Jean Pierre Diernaz explains the significance of C&C’s experience, commenting:
“C&C Taxis proves once again that Nissan electric vehicles work extremely well as taxis with huge cost savings for the business and big benefits to CO₂ emissions and air quality. These cars work hard, averaging 40 taxi fares and 240 km (150 miles) per day with zero reliability issues. It just works!”

C&C Taxi Fleet Manager Mark Richards commented:
“We have had such a positive experience with our Nissan LEAF fleet, even the drivers, who were anxious to start with are now very happy to drive a 100 percent electric car. They tell us a 10 hour shift is less tiring with an EV and the e-NV200 we have now means we can extend that experience to the drivers who were previously in diesel minibuses.”

“People often say that electric cars are just for cities, but we are in one of the most beautiful and rural counties of England with no cities or even motorways and they are working amazingly well for us. We are a family owned business and this is not a vanity project, this is something that is that is saving us money and getting us extra business.”

London Cabbies launch multi-million pound group action claim against Uber

London’s cab drivers are coming together as Cabbie Group Action to bring a potential group legal action against Uber worth over £500 million for damages and loss of earnings due to the alleged unlawful operation of Uber under the relevant statutory framework.

Commenting on the claim, the LTDA’s General Secretary, Steve McNamara said, “We recognise that there needs to be a level playing field between minicabs and licensed cabs on London streets but we believe Uber has operated unlawfully, resulting in a loss of earnings for many qualified licensed cab drivers. It is vital that they are recompensed for their losses. Perhaps only then will licensed cabs and Uber be operating on an even footing, which we all would welcome.”
Unite the Union’s Mike Hedges said, “Unite is pleased to support Cabbie Group Action against Uber. Cabbie Group Action is important in winning back the losses that taxi drivers have suffered.”

Fury As Lifer Policeman Serial Rapist Is Released After Only 7 years

Victims' fury as rapist policeman, 50, is freed from prison less than seven years after he was jailed for life for attacking up to 30 women he met on duty.

A rapist policeman has been freed from prison less than seven years after he was jailed for life for attacking up to 30 vulnerable women he had met on duty.

Stephen Mitchell raped and sexually abused heroin addicts and a disabled teenager by offering them help while in custody, then demanding sexual favours afterwards.

The former soldier was handed two life sentences at Newcastle Crown Court in 2011 and was told he would not be eligible for parole for at least seven and a half years.

But the 50-year-old has since been released and was seen enjoying life on the outside, riding a £500 bike, according to a report by the Sunday People.

Mitchell's victims and campaigners are outraged over his release, saying it was wrong Mitchell, who was deemed a 'high risk to women' by psychiatrists, was freed. 

One victim told the Sunday People: 'It's wrong that he can get on with his life, when he has ruined so many others.'

Another added: 'I certainly didn't expect him to get out so quickly.

'I have never, ever heard of anyone getting parole first time around for such a serious offence, given the fact he was so manipulative and never admitted anything.

'He deliberately chose victims who were vulnerable and wouldn't be ­believed if they ever dared speak up.'


She continued: 'I honestly think he has used everything he learned in the Army and the police to help him get parole by just telling them what he knew they would want to hear. He knows exactly what he's doing.

'He managed to get away with what he was doing, despite being in the police, so he is very cunning.' 

Labour's shadow home ­secretary Yvette Cooper called for the Parole Board to review its decision.

She said: 'We urgently need to know what the Parole Board's reasons were because to most people this really does not look like justice for victims. 

'The Justice Secretary needs to tell us urgently what progress he has made since his decision on John Worboys to stop the same things happening all over again.'

Uber driver found guilty four and a half years after the tragic death of six year old Sofia

Four-and-a-half years after the tragic death of 6 year old Sofia Liu who was run over while walking across a road in San Francisco, Uber driver Syed Abid Muzaffar, has been found guilty of vehicular manslaughter. On December 31, 2013, drove his Honda Pilot SUV through a crossing knocking over Sophia Liu, 6, her brother Anthony Liu, 5, and her mother Huan Hua Kuang. All three family members suffered serious injuries, with Sofia's proving fatal. Muzaffar has spent the last four-and-a-half years out on bail following being arrested and charged with one count of misdemeanour vehicular manslaughter. Kuang was adamant that she saw Muzaffar on his phone right before the collision that killed her daughter, but the Uber drivers public defender, Sliman Nawabi, said that the collision was caused by an infrastructure issue, not a case of negligence. Nawabi argued that is was because of bad visibility and the fact that the pedestrian light and the car traffic light had turned green at the same time which were the primary factors in the lead up to what he called "a tragic accident". Tom Ostly, District Attorney, did not agree with Nawabi's claims of it being "a tragic accident", saying that it would imply that there was nothing Muzaffar could've done to avoid hitting three people crossing the road at a "crosswalk". As reported in the SFWeekly, Ostly went on to say "You have a duty to whoever's in the crosswalk not to hit them. You don't drive unless you can see". After two days of deliberation, a jury determined that Muzaffar was guilty of vehicular manslaughter. The tragic death of Sofia and the huge medical bills of over $500,000 for her brother and mother, sparked immediate concern and debate to who would cover the insurance.
Uber said that because Muzaffar didn't have a job onboard they were not liable for any insurance bills, although Muzaffar did have the app on in between jobs. A lawsuit was filed against Uber on behalf of the family in 2014, and in 2015 the case was settled for an undisclosed amount. The whole case forced Uber to reconsider their insurance policy which now covers collisions and crashes caused by Uber drivers even if there is no passenger in the car when the incident occurs as long as the driver is logged into the drivers app and available to accept a ride. The grey area of how much responsibility big corporations take in such situations is still very much groggy, but in this instance both Muzaffar and Uber were held accountable in one way or another.
