Newcastle Taxi driver convicted after brandishing knife at passengers

via taxi-point https://ift.tt/2MG4Kb6
A taxi driver from Newcastle has found himself in court after he brandished a serrated kitchen knife to three passengers who he says became abusive and threatening at the end of a journey in West Denton. Police were called to the incident which took place on the evening of February 10. The weapon which was being concealed in the footwell of the drivers seat was seized. A court heard that taxi driver Abdul Bandas was just completing the journey when the three passengers began to act suspicious. Bandas thought that the three passengers didn't have the money to pay for the fare which is why they became aggressive and threatened him with a bottle of alcohol. An altercation ensued and a 16cm blade was pulled from the footwell by Bandas. There is no evidence that the father of four threatened to use the blade on the passengers, but instead was carried as a deterrent for anyone trying to assault him. Paul Harbison, defending, said: "He's a taxi driver and has been for a number of years. During the course of time, he has been the victim of numerous threats. "One can only describe deciding to have a knife as a gross error of judgment". District Judge Kate Meek said: "I think you know and I'm sure you have been told that the court treat offences of this nature seriously, whether or not you had intentions of using the knife. "If a situation arises and gets out of hand, even with your best intentions, they can end up using knives and killing people or causing life-threatening injuries, that's why it is an offence just to be in possession of one. "While it was not used here and it was you being assaulted, you did actually brandish it rather than leave it on the floor. I think you know how serious it is and how difficult situation you're in" Meek handed down a 20 week prison sentence, suspended for 12 months at North Tyneside Magistrates Court. Bandas was also ordered to do 60 hours of unpaid work. According to a report in the chronicleLive, Bandas has yet to inform the local authority of his conviction.

London group action follows Australian class action investigation into Uber over unlawful conduct

via taxi-point https://ift.tt/2vDNxbU
London’s cab drivers announced last week that they were to unite as Cabbie Group Action to bring about a potential group legal action against Uber worth over £500 million for damages and loss of earnings.
This announcement follows similar action in Australia. The Victorian Hire Car Association (VHCA) instructed lawyers Maurice Blackburn to investigate allegations that Uber was operating unlawfully from 2013 until midway through 2017, when new legislation came into effect. The proposed action is backed by Harbour Litigation Funding Ltd, the same funder of the recently announced London group action against the ride-hailing firm. In many cases Uber’s entry into the market has devastating consequences for the livelihoods of existing licence holders and drivers. If the investigation reveals that Uber’s entry in the Melbourne metropolitan area involved unlawful conduct, there may be grounds for a class action to recover losses on the part the affected law-abiding taxi and hire car operators and licence holders.
The action is the first proposed case of its type in Australia, with Canada the only other jurisdiction to pursue similar action. London’s cabbies have since followed suit. Presenting to the Annual General Meeting of the VHCA in November 2017, Maurice Blackburn Class Action Principal Ben Slade said there were at least 6000 taxi and hire licence holders in the Melbourne metropolitan area that were- impacted by the entry of Uber in allegedly unlawful circumstances. “It’s no secret that Uber’s entry into the market, in many cases, has had devastating consequences for the livelihoods of existing licence holders and drivers in the Victorian taxi and hire car industries,” Mr Slade said. “If our investigation reveals that Uber’s entry to the market involved unlawful conduct, there may be grounds for a class action to recover losses on the part of those affected. “We know there are thousands of taxi and hire care operators and license holders and we would anticipate strong interest from those that have felt the impact of Uber’s alleged unlawful entry into the Victorian market. “To those drivers and licence holders who are aggrieved and have suffered because of the way Uber entered the market, we invite them to register for our potential class action on our website from today, as we continue our investigation into the matter.”

Mihai-Ionut Borodea from Telford, who was operating approximately 30 miles outside of his licensing area, was caught at Shrewbury Station.
He agreed to take a fare from the station to Broseley after passengers approached him whilst making himself available for hire last December.
As a result of illegally plying for hire, Borodea's insurance was invalidated, along with the conditions of his private hire license.
Wolverhampton council officers worked closely in conjunction with Shropshire council officers to facilitate the prosecution.
Borodea received a £320 fine, which included costs, as well as six points added to his license, his private hire license will now also face a review.

The London Electrical Cab made its debut more than 120 years ago.

In August 2017, London’s first hybrid black cabs hit the streets ahead of new legislation that came into effect this year, requiring all new cabs to be ‘zero emissions capable’. The TX can operate for around 70 miles on battery power alone, with a petrol range extender allowing it to clock up around 400 miles before refuelling. But London’s very first electric cabs actually came into service exactly 120 years earlier.

"Mr W H Preece inaugurated a service of electrical cabs which are to ply for hire in the streets of London in competition with the ordinary hackney carriages," wrote The Engineer in August 1897. "Thirteen of these cabs are now ready for work, and a staff of drivers have been instructed in the use of them.

The cabs will be let out by the proprietors, the London Electrical Cab Company, Limited, just at the same rate and in the same manner as the London cabs. The ‘cabbies’ are, we are informed, quite enthusiastic about the new vehicle."

The London Electrical Cab – also commonly known as the ‘Hummingbird’ due to its sound, or the ‘Bersey Taxi’ after its young designer – first took to the streets of the capital on August 19 1897. Inventor Walter Charles Bersey was just 23 at the time, but had been designing and patenting electric vehicles for several years already. According to our predecessors, his creation was intended to mimic the appearance of the horse-drawn taxis of the day.

"The vehicle resembles very closely a horseless and shaftless coupé. It is carried on four wooden solid rubber-tired wheels. There is ample space for the coachmen. The accommodation within is luxurious. The propelling machinery consists of a 8-horse power Johnson-Lundell motor, with double wound armature and fields, so that by the use of a suitable switch or controller a variety of speeds can be obtained."

"The current is supplied by 40 EPS traction type cells, having a capacity of 170 ampere hours when discharged at a rate of 30 amperes. The cabs can thus travel between thirty and thirty-five miles per charge."

The vehicle had speed settings of three, seven and nine miles per hour, controlled by a lever at the side of the driver’s box. A powerful footbrake that broke the electrical circuit could also be applied, halting the vehicle in short order. This was one of four key conditions under which taxis were granted licenses by Scotland Yard, with carriages also required to be capable of turning in small spaces and climbing central London’s steepest ascent of the time, Savoy Hill.

The batteries, which weighed some 14 cwt (over 700 kg), were hung from springs underneath the vehicle and could be swapped out at Bersey’s Lambeth station using a system of hydraulic lifts. This was undoubtedly restrictive, and it was planned at the time to introduce other stations throughout London where the batteries could be charged and swapped. Though Bersey’s company claimed cab drivers welcomed the vehicle, it appears its introduction was not received as warmly from all quarters, as the following passage from a September 1897 edition of The Engineer illustrates.

"Mr. Walter C Bersey, the general manager of the London Electrical Cab Company, Ltd., has written to the general secretary of the London Cab Trade Council, saying that he fails to see how it can be contended that the introduction of electrical cabs can be against the interests of the cabdrivers. He says he has spoken to hundreds of cabmen on the subject, and has always understood they were most anxious for the change, as it would shorten their hours by saving the time wasted in changing horses, and also save them the unpleasantness of frequently having to drive tired and undesirable horses."

Despite Bersey’s protestations, the vehicle never really took off, with the fleet only reaching a peak of around 75 units. The cab’s two-tonne weight caused huge wear on the tyres which led to noise and vibrations escalating significantly after six months of use. Bersey’s company lost £6,200 in the first year of operation, and the business was forced to close in 1899, the vehicles disappearing from London’s streets just two years after making their debut.

Three men sentenced for selling fake private hire vehicle insurance policies.

via taxi-point https://ift.tt/2KMNY8v
Three men from Newham have been sentenced for selling fake private hire insurance policies to minicab drivers.
35 year old Ajay Haque from Forest Gate, Anik Dixit, 34 from East Ham and 33 year old Mohammed Nur Ahmed from Manor Park had set up a "ghost-broking" company, where they sold hire and reward insurance to private hire drivers but added drivers onto trade policies.
This scam meant that private hire drivers, despite being uninsured, would not show up to the police as being uninsured when checked.
The fake company, AHD solutions, sold the fraudulent insurance policies between June 2012 ans August 2013.
To give an air of respectability, AHD solutions added Esure onto their website without permission. Esure subsequently took legal action after finding their company name was being used illegally.
A total of 65 vehicles had been sold fake insurance documentation according to the Insurance Fraud Bureau.
There was no suggestion that any private hire drivers were complicit in the fraud the fraudulent activities of the three men.
The three men were sentenced for conspiracy to commit fraud at Snaresbrook Crown Court on August 7th.
Haque, who pleaded not guilty, received a two year prison sentence, suspended for 21 months. He also received and a nine hour curfew which will last for six months.
A 20 month prison sentence was issued to Dixit, who also pleaded not guilty, this however was also suspended for 18 months, and must complete 260 hours of community service.Ahmed who pleaded guilty, received a 17 month prison sentence which was suspended for 18 months, and must complete 220 hours of community service.
