“Uber has cost us all money; we must not let them get away with it” says LTDA’s McNamara

via taxi-point https://ift.tt/2P2yMaF
You will all have seen recent press reports that the law firm Mishcon de Reya is looking at whether there are grounds for taxi drivers to take collective legal action against Uber to claim back their lost earnings as a result of Uber’s illegal operation in London.
Ever since Uber invaded our streets in 2012, they have refused to stick to TfL’s regulations. They’ve intentionally driven down the wages of hard-working cabbies who operate within the rules and strive to maintain the high standards our trade is known for all over the world. We need to hold Uber accountable for its actions, and ensure that people who have lost money receive the compensation they deserve. Mishcon is still in the early stages of setting up the group action, but believes that there is a good case to be made against Uber. We need to get as many drivers as possible to sign up and help us make our case. Should we win, everyone who takes part in the group action will win back a share of their lost earnings from Uber. The case is being entirely funded by litigation funding firm Harbour, at no cost to cabbies. Any driver who is or has been licensed by TfL to operate in London will be able to take part. Even if you are now retired, you may be able to participate if it can be demonstrated that Uber coming to London caused a loss to your earnings. All you have to do at this stage is give your name, badge number and contact details to register your interest in taking part. This alone does not commit you to formally join in the legal action. Mishcon de Reya will then come back to you at a later date with more information about the group action and how it works, and will ask for more details about your individual losses. Uber has been skirting regulation in London at every opportunity to undercut the competition, drive cabbies and smaller local PHV firms out, and exploit its drivers. TfL and a certain magistrate may believe that Uber has changed but it’s clearly just a sham. The big question is, can we go after TfL as well? It’s early days, but the civil courts are a very different place to the criminal courts and all things are possible. I’m constantly told that the trade is divided and that we need more unity. Last week nailed that myth forever when, for the first time, representatives from every part of the trade met at Mishcon’s offices in the Kingsway. All the trade groups, large fleets, garages, apps, credit card processors, advertising and insurance companies, sat down together and agreed to back this action 100%. It is essential that everyone takes part in this group action. The more drivers who join us, the greater the claim. Uber has cost us all money; we must not let them get away with it, we must make them pay up. If you don’t have an internet connection or need help signing up, come to Taxi House in W9, or our office at Heathrow, where we will be pleased to help.

Uber investor Bradley Tusk Says Dara Khosrowshahi's kinder, gentler approach Is Makibg Uber Apoear Weak

Uber CEO Dara KhosrowshahiUber

 • Regulation critic Bradley Tusk, who is also an Uber shareholder, has some strong opinions on New York's new regulations that cap the number of ride-share drivers.

 • He believes that Uber's kinder, gentler approach these days could be interpreted as weakness by Uber's traditional rivals.

 • But an Uber insider tells us that times have changed, and Uber's view on its former rivals has changed with them.

Political-campaigner-turned-regulation-critic Bradley Tusk -who is also an Uber shareholder - has some unsolicited advice for Uber CEO Dara Khosrowshahi: Uber's kinder, gentler image isn't a good thing when it comes to a "bare knuckle fight" with would-be regulators who want to limit Uber's business.

"Effectively, if you want a CEO who is chosen because he is calm and smooth and avoids conflict at all costs, that may work really well in certain parts of the business. But when it comes to a sort of bare knuckle fight with the city council, you really have no chance at all," Tusk tells Business Insider.

Tusk's comments are in response to new rules approved earlier this week in New York, when Mayor de Blasio achieved something he had been wanting to do for three years: limiting the number of ride-sharing cars operating in the city.

Tusk's viewpoint poses interesting questions for tech startups fighting incumbents in heavily regulated industries.

Is there still a time and place for Silicon Valley's famous resistance to government regulations? The most extreme example of that attitude is Uber's brash former CEO Travis Kalanick, who fought them with gusto. But companies like Airbnb, FanDuel, Bird, and the bevy of self-driving car companies are all having their own stand-offs with city and state regulators. And in the years before Kalanick's spectacular fall from grace, he was widely praised in the Valley for his tactics in taking on the old-school incumbents...and winning.

In fact, in 2015 de Blasio tried to do this same thing, and limit the number of ride share drivers. But Uber engaged in an all-out assault of protests that was so powerful, it became the blueprint for how tech upstarts could combat would-be regulators.

It also catapulted the take-no-prisoners political operative who orchestrated Uber's counter-regulation campaign, Tusk, into a sought-after star helping other tech upstarts fight regulators.

Bradley TuskGetty

Tusk was paid in Uber stock to help Kalanick navigate New York's notoriously thick taxi regulations in those earlier days. Those shares of Uber, paid in lieu of Tusk Strategies' usual fees, were believed to be worth $100 million in 2017.

Tusk cashed out some of his Uber shares earlier this year, when SoftBank invested in the company and bought up equity from existing shareholders. However, he still owns a significant chunk of shares in Uber, he said.

But he says he's never met Khosrowshahi, much less advised him.

Still, he has some advice for Uber's current CEO.

"What I would say to him: there's a lot of areas where a kinder, gentler approach makes sense. But taxi is a cartel. Uber only exists because Travis and team were tough enough to take them on and fight them tooth and nail in every city in the United States," Tusk said.

"And if you don't do that, they are going to re-emerge," he warned. "They didn't become nicer people or kinder people. Or, just because you have a better reputation than Travis, they are all of a sudden going to treat you differently. More likely they are going to see you as weak and they are going to come after you."

Do nice guys finish last?

And yet, just because tough tactics worked in the past doesn't mean they are necessary for the future, argues a person familiar with Uber's New York operations, who requested anonymity to discuss the company's internal deliberations on this latest city council ruling.

"A lot has changed since 2015 in terms of driver and rider sentiment and how they feel about Uber has declined significantly. If this was a political campaign, Uber doesn't have a base anymore," this person said, adding that Uber has suffered a 30%-plus drop in reputation, even among riders.

That drop would have "weakened" the company's ability to rally protesters, should they have tried a repeat of the tactics used in 2015.

Also, under Khosrowshahi, Uber doesn't view the taxi industry as the all-out enemy anymore, this person said.

The company particularly has sympathy for the the drivers themselves hurt by the rise of ride-sharing, the person said. Six of them have committed suicide in New York, blaming Uber for destroying their livelihoods.

Plus executives believe that Uber, under Khosrowshahi, has won back the good graces of regulators in London and Buenos Aires, and that this is a better strategy than campaigning against them in the long-term.

Internally at Uber, executives nowadays didn't see much of a threat to their long-term business by capping the number of ride sharing vehicles on the road at current levels in New York for a year, this person said. They don't believe that New York will become a model for other cities instituting caps, as Tusk warns.

Meanwhile, even if Uber has moved on, Tusk has no shortage of takers that want his brand of fight. He's currently working with electric scooter rental company Bird and daily fantasy sports firm FanDuel.

Uber driver charged with negligent driving after British man falls from vehicle to his death

via taxi-point https://ift.tt/2MfWT7Y
An Uber driver in Sydney has been charged with negligent driving occasioning death after allegedly accelerating while one of his passengers was exiting his vehicle, causing him to fall in front of an oncoming bus to his death. Uber driver Nazrul Islam, 31, says he did not know that Mr Sam Thomas, a British man living in Sydney, was exiting the vehicle, claiming to not of seen the rear lights come on or hear the door open moments before accelerating away from a set of traffic lights in the early hours of the morning of June 17. A court heard that Uber driver Islam picked up Mr Thomas and two friends from a party at Strathfield in Sydney's inner-west. All three men were said to be under the influence of alcohol. Stephen Ronning, a friend who was in the front passenger seat of the Uber at the time of Mr Thomas's death, said he did see the interior light come on in the vehicle and also heard the back door open. As he turned around he saw Mr Thomas in the "motion of getting out" and turned to tell the driver to stop. A loud "pop" was heard which is when Islam stopped his vehicle. Ronning jumped out of the car to witness Mr Thomas laying in the road. Mr Thomas was killed instantly by the oncoming bus. According to a report in ABC, Mr Islam had told police that he works 50/60 hours a week for Uber and had been working that day since 6am. He said he was feeling ok after having two breaks of a few hours during his shift to sleep. Ali Cheema, Islam's defence barrister told the court that this was an extremely sad case but Islam was not negligent. The trial continues.

Consultation to bring parity between cyclists and motorists for road deaths begins

via taxi-point https://ift.tt/2vBI7xY
Road users would be kept safer under new government proposals that include changing the law and building better infrastructure.
A new consultation, open for 12 weeks from 12 August 2018, will look at whether a new offence equivalent to causing death by careless or dangerous driving should be introduced for dangerous cyclists.More is also being done to protect cyclists and pedestrians who use our roads safely, including a push for higher standards for cycling and walking infrastructure across the UK.These measures follow the launch earlier this summer of a UK-wide initiative to help police crackdown on dangerous drivers who pass cyclists too closely in a two-pronged approach to make our roads safer. The Department for Transport is also looking at updating parts of the Highway Code, including measures to counter the dangerous practice of ‘close passing’ which puts people off cycling, and would benefit other vulnerable road users like horse riders.Cycling and Walking Minister Jesse Norman said:“In recent weeks we have announced a range of measures designed to protect vulnerable road users such as cyclists and pedestrians. These include new measures to combat close passing, training for driving instructors, better collision investigation and £100 million in new investment through the Safer Roads Fund.“Now we are taking further steps. These include a consultation on new cycling offences, further work on national guidance on cycling and walking infrastructure, and improvements to the Highway Code.“All these measures are designed to support the continued growth of cycling and walking, with all the benefits they bring to our communities, economy, environment and society.”In 2016, three pedestrians were killed and 108 seriously injured after being involved in collisions with pedal cyclists.Matt Briggs, whose wife Kim was killed by a cyclist in 2016, said:“I welcome the government’s proposals for new legislation around causing death and serious injury by dangerous and careless cycling. This public consultation is an important step towards updating the arcane laws that are currently being used to prosecute cycling offences.“I would urge people to contribute to the consultation and of course to support the proposed changes to the law.“I also acknowledge that it is just under a year since I began my campaign for new legislation after the death of my wife, Kim Briggs, and I would like to thank the Department for Transport and in particular, Jesse Norman MP, for responding to my campaign in such a positive and expeditious manner.”As part of the Cycling and Walking Safety Review, the government has commissioned the Cycle Proofing Working Group to develop national guidance and best practice for cycling and walking infrastructure, so that all road users can benefit from the best facilities. Finally, the government has also announced today that £1 million will be provided to support the pathfinder demonstration projects for repairing and upgrading sections of the National Cycle Network.
